Consumer Terms

These are consumer terms for the Krat13 app. They describe the service that exists today. Nothing here limits rights that consumer law does not allow us to limit.

1. Who we are and when these terms apply

Krat13 is provided by Iraklii Tatoshvili, sole trader, Wrocławska 53M/70, Kraków, Lesser Poland, Poland (“Krat13”, “we”, “us”). These Terms apply when you download, install, buy, or use Krat13. You must be legally able to agree to them; where applicable, a parent or guardian must agree for a minor. The optional Google Gemini feature is separately restricted to users aged 18 and over. If you do not agree, do not use the app.

Krat13 is licensed, not sold. Your use on Apple devices is also subject to Apple’s Standard Licensed Application End User License Agreement and App Store rules. Mandatory law prevails over any conflicting term.

2. The service and your data

Krat13 helps you catalogue records and want-list items, look up public music information, log plays, estimate market values, import or sync selected Discogs data, and create exports. No Krat13 account is required. Your library is primarily stored on your device and, if you enable it, in your private iCloud/CloudKit container. We do not host a public copy of your library.

You keep ownership of the information, notes, and photos you add. You are responsible for having the right to use them, for any third-party personal information you enter, and for keeping a suitable backup. Local photos remain local/iCloud unless you deliberately submit sleeve photos to Premium Scan. The Privacy Notice explains every external data flow.

3. Licence and acceptable use

We grant you a personal, limited, non-exclusive, non-transferable licence to use Krat13 for lawful, non-commercial purposes on devices you own or control. Do not misuse the app or others’ rights; introduce malware; interfere with or overload the backend; evade subscriptions, rate limits, App Attest, or provider restrictions; scrape or extract services at scale; reverse engineer except where applicable law permits it; submit unlawful or infringing material; or use AI inputs to attack, jailbreak, or extract a model. We may proportionately restrict backend access where reasonably necessary for security, abuse prevention, law, or a material breach.

4. Device, sharing, and export features

Notifications are scheduled locally. Widgets and Siri/App Intents read a limited snapshot from the shared app container. “Now Spinning” Live Activities run locally without a Krat13 push server. NFC sleeve stickers store a Krat13 record deep link on the tag. Files, images, PDFs, CSV/JSON backups, and want-list links are created only when you ask; once you export or share them, you and the receiving app or person control the copy. A shared want-list link encodes selected record fields in the link and should be treated as readable by anyone who receives it.

5. Scanning, AI, metadata, and estimates

Premium Scan may send the sleeve photos you submit through our backend to Google Cloud Vision to read text and suggest a match. Optional Gemini enrichment runs only after you confirm you are at least 18 and give feature-specific permission in the app. You can use store-link import without Gemini and withdraw permission for future requests in Settings.

Scan matches, AI output, metadata, market prices, collection values, and inventory figures are estimates. They can be incomplete, outdated, or wrong. Verify important results independently. They are not an appraisal or financial, investment, insurance, tax, legal, or other professional advice. Third-party metadata and cover art remain subject to their owners’ rights and the source service’s terms.

6. Free features and Krat13 Pro

Current features and limits are shown in the app. Some features require a Krat13 Pro auto-renewing subscription. Apple is the merchant of record: Apple displays the price and billing period, charges your Apple ID, handles tax, renewal, cancellation, and refund requests, and does not give us your payment-card details. Manage or cancel in your Apple subscription settings. Cancellation normally stops the next renewal and does not remove access already paid for.

We may change features, limits, or future prices for valid product, security, legal, or operational reasons. Changes to a current paid period and notices will follow applicable law and Apple’s rules. Any statutory withdrawal, conformity, repair, price-reduction, termination, or refund right remains available where the law grants it; Apple may administer the payment remedy.

7. Third-party services

Requested features may depend on Apple, our backend host, Google services, Discogs, and public metadata, image, event, analytics, or diagnostics services. The current list and the data sent are in Service Providers & Transfers. Their availability and independent content are outside our control. A provider outage may make only the related feature unavailable.

8. Availability, updates, and changes

We provide Krat13 with reasonable care and skill but do not promise uninterrupted availability or that every third-party result is accurate. We may issue compatibility, security, or feature updates and may alter or discontinue a feature for a valid reason. Where required, we will give reasonable notice and preserve mandatory remedies. You can export your library without a Pro subscription; export regularly if the records matter to you.

9. Responsibility

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including mandatory consumer remedies, liability for fraud or wilful misconduct, or death or personal injury caused by negligence. Otherwise, to the maximum extent permitted by law, neither party is responsible for losses that were not reasonably foreseeable when the contract was made. Krat13 is a personal collection tool, not a business-critical archive; we are not responsible for a loss you could reasonably have avoided by using the available export and backup tools.

10. Ending use

You may stop using Krat13 at any time. Canceling a subscription, deleting app data, deleting iCloud data, disconnecting Discogs, and uninstalling are separate actions; the Privacy Notice explains their scope. We may block backend requests for serious or repeated misuse, security risk, or legal necessity, using a proportionate process and notice where required. Your locally stored data is not a hosted account that we can close for you.

11. Complaints and applicable law

Send product or contract complaints to support@krat13.app or the postal address below. State the problem, the remedy you seek, and contact details for the reply; do not send a full library or sensitive information unless requested. We will respond within the period required by applicable law. Apple handles App Store billing and refund requests, but you may also contact us about the service.

Polish law governs these Terms. If you are a consumer elsewhere, that choice does not remove mandatory protection or court rights of your country of residence. You may use the competent courts and, where available, a recognised out-of-court consumer dispute body; the European Commission lists bodies on its Consumer Redress portal.

12. Intellectual property

The app, Krat13 name, logo, and original interface are owned by Iraklii Tatoshvili or licensors. Open-source components remain governed by their licences. You may report an intellectual-property concern to the legal contact below. Krat13 does not operate a public user-content hosting platform or a developer-run takedown system.

13. Apple terms

These Terms are between you and us, not Apple. Apple is not responsible for Krat13 or its support. To the extent required by the App Store rules, Apple and its subsidiaries are third-party beneficiaries and may enforce these Terms. If the app fails to conform to an applicable warranty, you may notify Apple; Apple may refund the purchase price, if any, and other claims remain governed by applicable law and these Terms.

14. Changes and contact

We may update these Terms for legal, security, provider, or product changes. We will change the date above and give any additional notice or seek consent where law requires it. Changes do not retroactively remove accrued rights.
